Customer Interference & Liability Agreement
1. Booking & Deposit Policy
The Customer can change the date and time of their move with appropriate notice, but the booking deposit is strictly non-refundable under any circumstances.
2. Purpose
The purpose of this agreement is to ensure the safety of the Customer’s belongings, the Company’s staff, and all individuals present during the moving process.
3. Customer Non-Interference
While the Company’s staff are performing moving services, the Customer agrees not to move, carry, handle, or assist with the transportation of items that are being handled by the Company’s staff unless specifically requested or authorized by a Company representative.
4. Interruption of Moving Process
If the Customer, or any person acting on behalf of the Customer (including family members, friends, or other third parties), interferes with, interrupts, or participates in the moving process without authorization, the Customer acknowledges and agrees that such actions may increase the risk of damage or injury.
5. Liability for Damage & Special Waivers
If the Customer or any unauthorized person moves, assists with moving, or interferes with the handling of items while the Company’s staff are performing services, the Customer accepts full responsibility for any loss or damage that may occur to the Customer’s belongings, property, or surrounding premises as a result of such interference. In such cases, Ontario Movers and Packers shall not be held liable for any resulting damage.
Structural & Restricted Access Movement: The Company will not assume liability for damages resulting from non-routine moving activities. This includes situations where forced manipulation or hazardous moving operations are necessary due to limited space, navigating crowded work areas, negotiating difficult stairways, moving standing pieces vertically, working near sharp edges, handling items over balconies, maneuvering through tight spaces, working under harsh weather conditions, or at the Customer's request to purposefully damage walls, doors, or frames to accommodate large items.
The Company waives liability and/or damages arising from:
- Customer's request to opt out of using moving blankets and/or floor runners.
- Customer's request for packing without the use of packing paper.
- Customer's request to transport a mattress/box springs without a mattress bag.
- Customer's request for the mounting of TV, curtains, shelves, or any item requiring drilling or creating holes and/or dents on the wall or any surface.
- Items not under the Company's possession or control.
- Contents of boxes, bags, or containers packed by the Customer.
- Items not properly prepared by the Customer prior to the move.
- Unique or fragile items (including artwork, mirrors, or marble) not professionally packed by the Company.
- Furniture with unstable construction.
- Oversized furniture and items requiring maneuvering through tight spaces.
6. TV Mounting & Dismounting
We only unmount TVs when it is safe to do so, and the movers are allowed to refuse if they deem it unsafe. We do not mount TVs at any time.
7. Right to Pause or Refuse Service
The Company reserves the right to pause or stop the moving service if Customer interference creates unsafe working conditions or increases the risk of damage or injury.
8. Parking Responsibility
The Customer is responsible for ensuring proper, safe, and authorized parking space for the Company’s moving truck as close as reasonably possible to the service location. Parking tickets, fines, or towing fees incurred due to the absence of designated parking spots will be charged to the Customer and added to the invoice.
9. Stairs, Long Carry & Delays
The Customer is responsible for informing the Company in advance of any stairs, long walking distances, elevator requirements, or building restrictions. Delays caused by elevator waits or long carries may result in additional service charges.
10. Mandatory Payment Prior to Drop-Off / Unloading
The total moving charges, balance, and any applicable service fees must be paid in full BEFORE the moving truck is unloaded / drop-off commences. Acceptable methods of payment are certified cheque, Visa, Credit, Debit, or American Express. If payment is not made in full at the Unloading address, all items will be removed from the truck at the original loading destination, regardless of any non-refundable deposit made.
11. Immediate On-Site Inspection & Verification
Upon drop-off and placement of goods, the Customer is required to thoroughly inspect all items, furniture, and boxes in the presence of the moving staff to confirm condition and verify that nothing is damaged, broken, or missing.
12. Zero Liability After Departure (No Claims Accepted Once Crew Leaves)
Once the Ontario Movers and Packers crew completes the drop-off and departs / leaves the service location, the Company accepts ZERO liability for any claimed damages, scratches, dents, structural breakages, or missing items. All claims must be made to us on the date of the move and 1 day after unloading. The Customer must provide damage furniture invoices for any claims. No damage, scratch, or missing item claims will be accepted or processed after this period.
13. Standard Cargo Protection & Insurance Coverage ($1.30 / lb)
Ontario Movers and Packers provides standard released valuation cargo protection coverage up to a maximum rate of $1.30 per lb (pound) per damaged or lost article. This coverage applies strictly to items that were professionally wrapped, blanketed, and handled exclusively by Ontario Movers and Packers personnel. Any goods where furniture wrapping was waived, customer-packed boxes, or claims submitted after the moving crew has departed the premises are completely excluded from this coverage.
14. Agreement Conflict
In the event of any conflict between this agreement and other service contracts signed by the Company and the Customer, the terms of this agreement shall prevail.
For a covered article weighing 50 lbs, carrier liability is strictly calculated as 50 lbs × $1.30 = $65.00 CAD maximum recovery, irrespective of retail cost.
